In general the two classifications are noted below:

1. Construction Industry: An employer in the construction industry who employs one or more part or full-time employees must obtain workers' compensation coverage (the rate of the insurance is based on the risk factor).

2. Non-Construction Industry: An employer in the non-construction industry, who employs four or more part or full-time employees, must obtain workers' compensation coverage.


If you have less than 3 employees you are considered “Self Insured” and if an accident would occur you could be held responsible for all medical expenses (and for lost wages for as long as the individual is disabled). I have workers comp insurance and have had it for years.

Workers Comp is not General Insurance, and is a separate policy.

Check with “Independent Insurance Agencies” for quotes on Worker’s Comp Insurance (normally large insurers have high costs for small business who need this type of insurance), independent agencies can shop the insurance to many other smaller insurers who normally can offer a lower “affordable” rate/s.


We have been working with two payroll companies (Paychex and ADP) who offer the full coverage for the insurance billed as part of the payroll services (normally without any large payment to begin) which is added to the monthly invoice (this has saved many clients huge amounts during the last 15 years). If you use a payroll processing company check with them to see if this is available.
